Property Investment in Cambodia

Foreigners cannot own land directly under Article 44 of the Cambodian Constitution. Multiple legally established structures exist and are government-endorsed.

Constitutional framework: Only Khmer nationals may own land. The Ministry of Land Management has formally confirmed all four structures below are legally sound government-endorsed pathways for foreign investment.
Condominium freehold — simplest route

Under the Foreign Ownership Property Law (2010) and Strata Title Law (2009), foreigners may own strata-title condominium units with a national-level hard title. Landed Property Ownership Structures

A — Long-term leasehold (most common)

Lease agreements run 15–50 years with renewal provisions extending to 100 years. Leases registered at the National Cadastral level attach the right to the title deed — the tenant is protected even if the landowner sells.

B — Land-holding company

A Cambodian-registered company holds the property. Foreigners may own up to 49% of shares. Requires robust shareholders' agreements. Commonly used for commercial real estate and development projects.

C — Trust structure (2019 Trust Law)

A licensed Cambodian trustee holds legal title while the foreign investor retains beneficial ownership. As of early 2026, 1,175 trusts worth $1.74 billion are registered — growing adoption. Subject to ongoing regulatory updates.

D — Nominee structure
